EU-US Privacy Shield Framework & Privacy Statement

Intermedix Corporation and its subsidiaries (“Intermedix”) comply with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use and retention of personal information from European Union member countries.  Intermedix has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability.  If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification page, please visit https://www.privacyshield.gov/

Compliance with Privacy Principles

Notice of Use; Access.

Intermedix may collect personally identifiable information, such as name, place of business, address, telephone number, or electronic mail address, but only if provided voluntarily by you.  Personal information may be requested if you: (1) use the website to request information about our products and services; (2) use the website to register for an Intermedix-sponsored event such as a user conference or training program; (3) use the website to download software updates or access demonstration software; or (4) request an online account to participate in discussion groups, conduct business or receive services.  

Intermedix may use the information voluntarily provided to verify any information needed to satisfy information requests, perform requested actions, complete requested transactions or otherwise conduct business with the person providing the information.  Intermedix also may use the information to initiate contact about related events, products and services that may be of interest.

Certain information, such as a computer’s Internet Protocol address, may be stored in the “cookies” used to efficiently transfer information via the internet.  This information may include the Internet address of your computer or network, the date, time, and page you visited on our site, your browser and operating system, and the referring page. Intermedix collects these site visitation statistics using “cookies.”   Intermedix only uses this information in aggregated form and only for improving our website, and does not use “cookies” or other electronic files to store personal or personally identifiable information.  To maintain privacy of personal information, you can configure your browser to accept or reject all cookies, notify you when a cookie is set or enable the “private browsing” feature on any computer used to access the Intermedix websites.

The Intermedix websites may include links to the websites of our business partners, business associates or other third parties.  Intermedix has no control or influence over the privacy practices of any third party websites.  Intermedix  highly recommends that any person accessing a third party website through an Intermedix website carefully review the privacy policies posted on each and every website visited prior to disclosing any personal or personally identifiable information.

 
Choice.

All mass publications distributed by Intermedix will include “opt out” provisions. The “opt out” provisions clearly state how to unsubscribe from any future mailings, e-mailings or other communications from Intermedix.  Individuals also may contact Intermedix via email at compliance@intermedix.com to request removal from some or all distributions, and to request deletion of any personal information stored by Intermedix to the fullest extent allowed by law.

Accountability for Onward Transfers.

Intermedix will take all reasonable and prudent measures to safeguard any personal or personally identifiable information shared with us against unauthorized disclosure. Intermedix does not sell or disclose personal information, including email addresses, to third parties, partners, or affiliates.  Intermedix will only utilize the information provided to us in the manner described in the Notice section of this policy.  Intermedix also may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.  Intermedix may be liable for onward transfer to third parties of EU or Swiss data received under the Privacy Shield Framework in the event that such transfer occurs without consent of the data’s rightful owner.

 
Security

Intermedix maintains an information security program to protect all data in its possession, including personal and identifiable information, from loss, misuse and unauthorized disclosure.  Protective measures include, but are not limited to, policies, procedures, and manual and automated controls.

Data Integrity and Purpose Limitation.

Intermedix will only utilize the information provided to us in the manner described in the Notice section of this policy.

Enforcement and Liability.

Enforcement of Privacy Shield Principles will be managed by the Federal Trade Commission (“FTC”). By certifying its compliance with the Privacy Shield Principles and Framework, Intermedix agrees to submit to the investigatory and enforcement authority of the FTC. 

Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.

Resolution of Complaints, EU Individuals

In compliance with the EU-US Privacy Shield Principles, Intermedix commits to resolve complaints about your privacy and our collection or use of your personal information.  European Union individuals with inquiries or complaints regarding this privacy policy should first contact Intermedix’s Privacy Officer:

Intermedix has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers/ for more information and to file a complaint.

EU individuals also may submit complaints about the improper collection or use of personal data directly to a EU data protection authority (“DPA”).  The DPA will submit a copy of the complaint to the US Department of Commerce to facilitate resolution.
